01 Definitions
- "Garuda Law", "we", "us", "our" — the firm operating under that name at 174 Sathorn Road, Sathorn, Bangkok 10120, Thailand.
- "Client", "you", "your" — any individual or entity that engages Garuda Law for legal services or uses our website.
- "Services" — the inheritance and estate legal services described on our website and in any engagement letter, including consultation, estate administration support, and full case representation.
- "Website" — the site operated at garudawonfin.world and its sub-pages.
- "Agreement" — these Terms & Conditions together with any engagement letter or service agreement between us.
- "Engagement Letter" — a written document issued by Garuda Law setting out the scope, fees, and specific terms of a particular matter.
02 Acceptance of Terms
By using our website or submitting an enquiry form, you acknowledge that you have read and understood these Terms. By signing an Engagement Letter or otherwise instructing Garuda Law to act on your behalf, you agree to be legally bound by this Agreement.
- You must be at least 18 years of age and have the legal capacity to enter a binding agreement.
- If you are acting on behalf of an estate, company, or other entity, you confirm that you have authority to bind that entity.
- Use of our website for informational purposes does not alone constitute an attorney–client relationship.
03 Description of Services
Garuda Law offers three primary service paths, each described on our Solutions page:
- Inheritance Guidance Consultation (฿4,550) — a private advisory session with a written summary of options. Scope: one session.
- Estate Administration Support (฿9,800) — document preparation, filings, and correspondence management over one to three months.
- Full Inheritance Case Representation (฿17,400) — complete handling of a contested or complex matter from opening to close, including a closing report.
The precise scope of services for your matter will be set out in your Engagement Letter. Garuda Law will use professional judgment in determining the appropriate approach within that scope, but will discuss any material changes with you before proceeding.
Our services are available in Thailand. Matters involving foreign jurisdictions may require referral to or coordination with lawyers admitted in those jurisdictions, which we will explain at the outset.
04 Client Responsibilities
A successful outcome in any legal matter depends on collaboration. You agree to:
- Provide us with complete, accurate, and timely information and documents relevant to your matter.
- Inform us promptly of any change in circumstances that may affect your instructions or the matter.
- Keep us informed of your contact details so we can reach you in a timely way.
- Not take actions in respect of the matter without first consulting us where those actions could affect the legal position.
- Ensure that any documents or information you provide do not infringe the rights of third parties.
- Pay fees as agreed in the Engagement Letter.
We reserve the right to suspend work on a matter if we do not receive instructions, information, or payment when reasonably requested.
05 Fees and Payment
Our fees are set out in the Engagement Letter for your matter. Unless otherwise agreed:
- Fees are quoted and payable in Thai Baht (฿).
- Payment methods accepted include bank transfer and major credit cards as specified at invoicing.
- Disbursements (court fees, official charges, translation costs) are charged in addition to professional fees and will be itemised in our invoices.
- Invoices are due within 14 days of issuance unless alternative arrangements are stated in the Engagement Letter.
- For the Full Representation service, a phased fee schedule may be agreed to suit the circumstances of your matter.
Refunds: Fees for work already performed are not refundable upon termination. If you cancel a Consultation appointment with less than 48 hours' notice, the fee may be retained in full. In other circumstances we will consider refund requests fairly and on their merits.
06 Confidentiality
All information you share with us in connection with your matter is treated as strictly confidential. We will not disclose it to third parties except as required by law, court order, or with your express consent. Our professional obligations under Thai law reinforce this commitment. The duty of confidentiality continues after our engagement ends.
07 Intellectual Property
All content on our website — including text, design, layout, and compiled information — is the property of Garuda Law or its licensors. You are granted a limited, non-exclusive, non-transferable licence to view and download website content for personal, non-commercial reference only. You may not:
- Reproduce, republish, or distribute our content without prior written consent.
- Use our name, branding, or materials in a way that implies endorsement or affiliation.
- Reverse-engineer or extract data from our website by automated means.
Documents prepared specifically for your matter remain subject to professional privilege. Our general guidance materials remain our intellectual property.
08 Disclaimers
General website content is provided for informational purposes and does not constitute legal advice. An attorney–client relationship is formed only upon execution of an Engagement Letter.
- We make no representations that outcomes in any matter can be predicted or assured; legal proceedings involve inherent uncertainty.
- The website is provided on an "as available" basis; we do not warrant uninterrupted or error-free access.
- Third-party links are provided for convenience only; we are not responsible for the content or conduct of linked sites.
09 Limitation of Liability
To the extent permitted by applicable Thai law:
- Our total liability to you for any claim arising out of or connected with our services shall not exceed the total fees paid by you for the specific matter from which the claim arises.
- We shall not be liable for indirect, consequential, or special losses, including loss of opportunity or loss of anticipated benefit.
- Nothing in these Terms limits liability for fraud, wilful misconduct, or any other liability that cannot be excluded by law.
10 Termination
By you: You may end the engagement at any time by written notice. You will be liable for fees covering work completed to the date of termination.
By us: We may withdraw from a matter on reasonable written notice where continued representation would be professionally untenable, such as if instructions require us to act contrary to law or professional obligations, or if fees remain unpaid after reasonable request.
Provisions that by their nature survive termination — including confidentiality, payment obligations, and limitation of liability — remain in effect after an engagement ends.
11 Dispute Resolution
These Terms are governed by the laws of the Kingdom of Thailand. In the event of a dispute:
- We ask that you first contact us at [email protected] so we can attempt to resolve the matter informally within 30 days.
- If informal resolution is not possible, disputes shall be subject to the jurisdiction of the competent courts in Bangkok, Thailand.
12 General Provisions
- Entire agreement: This Agreement constitutes the entire agreement between the parties in respect of the subject matter and supersedes all prior discussions.
- Severability: If any provision is found unenforceable, the remainder of the Agreement continues in effect.
- Waiver: Failure to enforce any right does not constitute a waiver of that right.
- Assignment: You may not assign your rights under this Agreement without our written consent. We may assign our rights to a successor practice.
- Notices: Formal notices should be sent by email to the contact addresses on file, with written confirmation by post where required by law.
- Updates to Terms: We may update these Terms periodically. The revised version will be posted on our website with a new "Last Updated" date. Continued engagement after that date constitutes acceptance.
